TERMS AND CONDITIONS OF THE ONLINE STORE AND REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES

These Terms and Conditions define the rights and obligations of the Seller and the Customer related to the use of the website and online store available at the domain http://wodeckitwistfestiwal.pl/sklep, including:

  • agreements for the provision of electronic services,
  • rules for concluding sales contracts for products available in the online store,
  • rules for concluding contracts for the delivery of digital content through the store,
  • rules for concluding contracts for the provision of services offered or to be offered in the online store,
  • including the rules and procedure for exercising the right of withdrawal from the contract by a Customer who is a consumer.

In the scope of electronically provided services, these Terms and Conditions constitute the regulations for the provision of electronic services, as referred to in Article 8(1)(1) of the Act of July 18, 2002, on the provision of electronic services.

Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings indicated below:

  • Business Day – any day from Monday to Friday, excluding statutory public holidays.
  • Contact Form – an electronic service, a form available in the Online Store at http://wodeckitwistfestiwal.pl/sklep, through which questions can be sent to the Seller.
  • Order Form – an electronic service, an interactive form available in the Online Store enabling the placement of an Order.
  • Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but with legal capacity, having a place of residence or registered office in the Republic of Poland.
  • Consumer – a Customer who is a natural person with full legal capacity, entering into or intending to enter into an agreement with the Seller that is not directly related to their business or professional activity.
  • Individual Entrepreneur (Entrepreneur with Consumer Rights) – a Customer who is a natural person entering into or intending to enter into an agreement with the Seller directly related to their business activity, where the agreement does not have a professional character for them.
  • Civil Code – the Civil Code Act of April 23, 1964.
  • Product – any movable goods offered by the Seller in the Store.
  • Electronic Product/Digital Content – digital content available in the Online Store in the form of an electronic file in .doc or .pdf format, which is the subject of a Sales Agreement between the Customer and the Seller.
  • Services – all services provided by the Seller as part of its core business or statutory activity, if offered through the Store.
  • Electronic Service – a service provided electronically by the Seller to the Customer via the Online Store, including:
    • providing Customers with access to pages and subpages at http://wodeckitwistfestiwal.pl, including the Online Store,
    • sending commercial offers to Customers and others who consent (newsletter/subscription),
    • enabling Customers to contact the Seller directly via the website using the contact form,
    • if available, enabling Customers to create and manage an account in the Store (Customer Account).
  • Terms and Conditions – these Online Store Terms and Conditions.
  • Online Store/Store – the Seller’s online store available at http://wodeckitwistfestiwal.pl/sklep.
  • Seller – Zbigniew Wodecki Foundation, Ul. Św. Sebastiana 4 m.9, 31-049 Kraków, KRS 0000693956, NIP 6762535688, REGON 368225314, email: office@fundacjazbigniewwodecki.pl.
  • Newsletter – an Electronic Service involving sending HTML-formatted emails containing commercial information and other information related to the Seller’s activities.
  • Agreement – a sales agreement for a Product, an agreement for the delivery of digital content, an agreement for the provision of electronic services, or a service agreement, concluded between the Customer and the Seller via the Online Store.
  • Consumer Rights Act – the Act of May 30, 2014, on Consumer Rights (Journal of Laws 2020, item 287).
  • Order – a declaration of intent to conclude a contract for the purchase of a product (including electronic) or services (including digital) by the Customer, submitted via the Order Form and aimed directly at concluding an agreement with the Seller.

§2 Preliminary Provisions

  1. The Seller conducts sales of Products, Electronic Products, provides Electronic Services, and may offer other Services consistent with its business activity via the Store.
  2. These Terms and Conditions define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and Customers.
  3. No special technical requirements are necessary to use the Store, including placing an order. The following are sufficient:
    • Internet access,
    • a standard, up-to-date operating system,
    • a standard, up-to-date web browser (e.g., Opera, Mozilla Firefox, Google Chrome, Safari) with cookies enabled,
    • an active email address.
  4. For digital content, additional standard, widely available software may be required (e.g., DOC, PDF, MP4, MP3, MOV, AVI). Any additional technical requirements will be clearly indicated in the Store.
  5. Agreements cannot be concluded anonymously or under a pseudonym. Customers must provide accurate and complete personal data.
  6. Customers are prohibited from providing unlawful content and must use the Store in accordance with applicable laws, these Terms and Conditions, and good practices, respecting personal rights and intellectual property.

§3 General Information on Agreements and Placing Orders

  1. Depending on the type of Product or Service, the following agreements are concluded:
    • for Products – a sales agreement,
    • for Electronic Products – an agreement for the supply of digital content,
    • for Electronic Services – an agreement for the provision of electronic services,
    • for Services – a service agreement.
  2. If an Order includes different types of Products, multiple agreements are concluded.
  3. The Online Store displays all currently offered Products, Electronic Products, and Services, including descriptions and prices in PLN (including VAT).
  4. For events organized by the Seller, participation terms and ticket purchase information may be in a separate document on the Store’s website.
  5. The Store is available 24/7, but Orders placed on weekends or holidays are processed on the next Business Day.
  6. Customers can place Orders as registered users or guests. Payment methods include:
    • electronic transfer via Przelewy24,
    • bank transfer (after contacting the Seller).
  7. Payment must be made immediately after placing the Order unless otherwise specified.
  8. The Order process involves:
    • selecting Products/Services,
    • providing required information (e.g., Customer details, payment/delivery method),
    • reviewing the total price (including delivery),
    • accepting the Terms and Conditions and completing payment.
  9. The Seller may cancel Orders if the form is incorrectly filled out or if payment is not made within 7 Business Days.
  10. The Seller reserves the right to refuse or cancel Orders placed anonymously or using automated systems.

§4 Price

  1. Prices are gross and include all taxes unless stated otherwise.
  2. The Seller is a VAT payer.
  3. Prices do not include delivery costs, which are displayed before Order confirmation.
  4. The Seller may change prices or promotions, but such changes do not affect concluded Agreements.
  5. For perishable goods, the original price is displayed alongside the reduced price.

§5 Electronic Services

  1. The primary Electronic Service is enabling Customers to place Orders.
  2. If available, Customers may create an Account to store their data and Order history.
  3. The Newsletter service is optional and can be unsubscribed from at any time.
  4. The Contact Form enables direct communication with the Seller.
  5. Electronic Services are free, while Product sales, digital content, and other Services are paid.
  6. The Seller implements security measures to protect data.
  7. Customers should report any Store malfunctions.
  8. Complaints are processed within 14 days.

§6 Services

  1. Services offered in the Store can be ordered via the described process.
  2. Orders are binding upon clicking “Buy and Pay” and are confirmed via email.
  3. If a Service can be purchased for a third party, this will be indicated in the Service description.

§7 Products

  1. Orders are binding upon clicking “Buy and Pay” and are confirmed via email after payment.
  2. Products are shipped after full payment, including delivery costs (visible before payment).
  3. Orders are delivered throughout Poland.

§7 Electronic Products

  1. Access to Electronic Products is granted immediately after payment (within 48 hours max).
  2. Products may be accessed via the Customer Account or emailed as a file.
  3. For group access (e.g., social media groups/webinars), access is granted immediately or as specified.
  4. Access duration may be limited or unlimited, as stated in the offer.
  5. Customers must contact the Seller if they cannot open files.
  6. The Seller informs Customers about updates, including security-related ones.

§8 Right of Withdrawal

  1. Consumers may withdraw from distance contracts within 14 days of receiving the Product or concluding the Agreement (for digital content/services).
  2. Exceptions apply (e.g., personalized Products, perishable goods, opened sealed Products, digital content with immediate access, event tickets).
  3. To withdraw, Consumers must notify the Seller via email or post.
  4. Products must be returned within 14 days of withdrawal at the Consumer’s cost.
  5. Refunds are issued within 14 days using the original payment method.
  6. Consumers are liable for value reduction due to unnecessary handling.
  7. Individual Entrepreneurs may withdraw under the same conditions if the Agreement is not professional.

§9 Complaints (Products, Electronic Products, Services)

  1. The Seller is liable for defects in Products, digital content, or Services.
  2. Complaints should include details of the issue and the claimed remedy.
  3. Complaints can be submitted via email or post and are processed within 14 days.
  4. Liability is excluded for non-consumer Entrepreneurs.

§10 Complaints (Electronic Services)

  1. Complaints about Electronic Services should include details of the issue and contact information.
  2. Complaints are processed within 14 days.

§11 Copyright

  1. All materials (texts, photos, graphics, multimedia, trademarks) are protected by copyright.
  2. Unauthorized distribution, modification, or commercial use is prohibited.
  3. Violations may result in access termination and legal action.

§11 Personal Data and Cookies

  1. Providing personal data is voluntary but necessary for contract conclusion.
  2. The Seller is the data controller.
  3. Data is processed for contract fulfillment, account maintenance, newsletters, and correspondence.
  4. The Store uses cookies.
  5. Details are in the Privacy Policy at http://wodeckitwistfestiwal.pl/.

§12 Out-of-Court Complaint and Redress Methods

  1. Consumers may use mediation, arbitration, or the ODR platform (http://ec.europa.eu/consumers/odr).
  2. More information is available at http://polubownie.uokik.gov.pl.

§13 Final Provisions

  1. Agreements are concluded in Polish.
  2. Polish law and courts apply.
  3. The Seller may amend the Terms and Conditions for important reasons (e.g., legal changes, technical updates).
  4. Changes are announced 14 days in advance via the Store and email.
  5. The current and archived versions of the Terms and Conditions are available on the Store’s website.
